On June 1, 2020, FMCSA revised the hours of service (HOS) regulations to provide greater flexibility for drivers without adversely affecting safety. Motor carriers are required to comply with the new HOS regulations starting on September 29, 2020, not before.

What is Changing?

1. Short-haul Exception

Expands the short-haul exception to 150 air-miles and allows a 14-hour work shift to take place as part of the exception.

2. Adverse Driving Conditions Exception

Expands the driving window during adverse driving conditions by up to an additional 2 hours.

3. 30-Minute Break Requirement

Requires a 30-minute break after 8 hours of driving time (instead of on-duty time) and allows an on-duty/not driving period to qualify as the required break.

4. Sleeper Berth Provision

Modifies the sleeper berth exception to allow a driver to meet the 10-hour minimum off-duty requirement by spending at least 7, rather than at least 8 hours of that period in the berth and a minimum off-duty period of at least 2 hours spent inside or outside the berth, provided the two periods total at least 10 hours, and that neither qualify period counts against the 14-hour driving window.

DWW PlacardThe Department of Transportation (DOT) Special Permit DOT-SP 11329, first granted to Degesch America, Inc. in 2005 was scheduled to expire on April 30, 2019.  Degesch America, Inc. applied for the renewal of the Special Permit in January, and we are pleased to report, the application has been approved.  Under the terms of the Special Permit, operators transporting our products, Phostoxin®, Magtoxin®, Fumitoxin® and Detiaphos® are exempt from specific DOT regulations under certain conditions.

Operators who meet the requirements of the Special Permit are not required to are not required to affix Hazardous Material placards to their vehicle or possess a Commercial Drivers License to transport less than 21 kg of properly marked products.

GAFTA_Approved_Fumigator_LogoGafta (The Grain and Feed Trade Association) is the international Association representing the trade and supply of agricultural commodities, animal feed materials, pulses, rice, spices and general produce worldwide.  The Gafta Standard is an independently audited scheme designed to maintain and improve the level of competence of activities related to the trade of agricultural commodities, animal feed materials, pulses, rice, spices and general produce worldwide.

It comprises three Codes of Practice:
• The Gafta Standard for Analysis and Testing
• The Gafta Standard for Fumigation
• The Gafta Standard

The Gafta Standard for Fumigation covers the management and operational procedures of the Fumigator (and his trained representatives) when carrying out the fumigation and degassing of agricultural commodities on a ship, in a store/silo or in freight containers in relation to food/feed safety. It details best practice procedures of the Fumigator within the scope of his responsibility, including the handing over of responsibility to the owner or custodian of the commodity when required.  Certification to the Gafta Standard for Fumigation is a requirement for listing a company on the Gafta Approved Register of Fumigators. Being on the Approved Register enables a fumigation company to carry out its activities under Gafta contract terms.

DDGSIn a letter to USDA APHIS Deputy Administrator Mr. Osama El-Lissy the Director General of the Plant Protection Department, Vietnam, Mr Hoang Trung announced the decision to lift the suspension on the importation DDG from the United States. The letter states in part:

“…the Minister of Agriculture and Rural Development of Vietnam has issued the Decision No 3566/QD-BNN-BVTV dated September 1st 2017 to resume import of DDGS from United States into Vietnam.
In order to implement the Decision, the Plant Protection Department of Vietnam (PPD) will issue phytosanitary import permits for U.S. DDGS from September Pt, 2017. The phytosanitary import permit shall be delivered by PPD to the importer. This phytosanitary import permit will be presented by the U.S exporter to APHIS to request a phytosanitary certificate.
In additional, PPD would like to inform that phosphine is accepted for treatment of DDGS, corn and wheat from the U.S before export to Vietnam, complying with the agreed treatment procedures (see the attachment). The information of fumigation including date, location of the fumigation, fumigant, duration and temperature of treatment should be specified in the phytosanitary certificate.
However, if any interception of living quarantine pest of Vietnam, PPD will apply the phytosanitary measures according to our regulations.”
